Definitions
The “client” (also referred to as the “customer”) is the party to whom e-Lation Computer Services provide Services or Goods as agreed by the signing of the Terms and Conditions of Business below.

The Terms and Conditions of Business are outlined below, to be signed by the client before the supply of Services or Goods.

Terms and Conditions
The following are the Terms and Conditions for the supply of Services or Goods. Please read these Terms and Conditions carefully because they tell you the rights and obligations you have. You may have other rights granted by law and these Terms and Conditions do not affect these nor do they affect your statutory rights as a consumer.

Purchasing Goods and Services
We are not VAT registered, all prices are in GBP sterling. All prices and offers are subject to change and availability and may be withdrawn at any time. We reserve the right to change any advertised price at any time from that stated on www.e-lation.org.uk. Prices are checked regularly, however if we find the price has changed when we receive your order we will inform you and ask if you wish to proceed. If for any reason Goods or service ordered are not available you will be offered an alternative. We cannot be held liable whatsoever if we are prevented or delayed from supplying or making delivery of any Goods or Services by any reason or cause.

Payment Methods
All our charges are in units of 30 minutes (half and hour). The minimum charge is therefore a half hour charge plus the call-out charge, subject to the No-Fix, No Fee policy. See below. Payment is due on completion of the work unless otherwise agreed by e-Lation Computer Services. We accept payment by cash or cheque with a cheque guarantee card. Cheque should make payable to e-Lation Computer Services.

No Fix, No Fee Policy
e-Lation Computer Services offers a No-Fix, No Fee service. e-Lation Computer Services reserve the right to waive the No-Fix, No Fee policy before booking an engineer. The Customer will be informed before hand if the problem reported falls into this category. Callout fee is payable irrespective of whether the fault has been fixed. In addition, No-Fix, No Fee applies to the first problem reported to us. Additional problems can be reported to the call taker or engineer when he visits but these will come outside the No-Fix, No Fee. If the first problem reported is fixed but subsequent problems are not fixed, charges for the whole time the engineer has spent are payable. No-Fix, No Fee only applies to problems we cannot fix or are uneconomical to fix, not to problems the customer does not want us to fix.

E-lation Computer Services does not offer telephone support.

Limits of liability
e-Lation Computer Services will not be liable for any claims, penalties, loss, injuries, damages or expenses arising from the service or the use or the inability to use the system or from any unauthorised access or alteration to the IT system [by a third party]. Customers should perform a system backup before a visit by an engineer. e-Lation Computer Services will not be liable for any loss of data experienced by the client. If requested, e-Lation Computer Services will attempt a back-up of the client’s data and will charge for this service in accordance with the pricing levels stated above. e-Lation Computer Services will not be responsible for any crashes, losses, claims, penalties, fines, damages, or expenses from the installing of any programs installed by e-Lation Computer Services or the client.

Governance of the Terms and Conditions
English law governs these Terms and Conditions. Any disputes will be referred to the exclusive jurisdiction of the English Courts.

ANY ADVICE OR COMMUNICATION GIVEN BY E-LATION COMPUTER SERVICES IS PROVIDED BY E-LATION COMPUTER SERVICES ON AN "AS-IS" BASIS. E-LATION COMPUTER SERVICES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF ADVICE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON ANY COMMUNICATION, INCLUDING BUT NOT LIMITED TO EMAIL, TELEPHONE, FAX, VERBAL, OR OTHERWISE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, E-LATION COMPUTER SERVICES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. E-LATION COMPUTER SERVICES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING AS THE RESULT OF ADVICE OR COMMUNICATION BETWEEN E-LATION COMPUTER SERVICES AND THE CLIENT, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES
